Employment Litigation
Many of our clients work in regulated industries (such as health care, financial services and technology), and that presents a further challenge in managing risk arising out of employment matters. When employment disputes mature into litigation, our clients rely on us to manage their litigation portfolios effectively and efficiently.
HR matters often require swift and immediate action. We regularly act as on-call troubleshooters to help clients implement immediate solutions that minimize ongoing risk. We routinely advise on disciplinary matters and terminations and assist in reviewing and drafting supporting documentation. We also conduct investigations to help get to the bottom of risky employment issues with an eye toward risk mitigation and early resolution. We also proactively help develop workplace policies and protocols aimed at best positioning clients to handle workplace issues as they arise.
On the litigation front, we routinely defend clients in cases that run the gamut of California employment claims, from single-plaintiff wrongful termination claims, to representative PAGA claims and class actions. We also help clients protect their valuable intellectual property when high-level employees leave. We have secured critical preliminary injunctions halting former executives from misappropriating propriety assets during pending litigation.
Employment Litigation Representative Matters
Obtained a complete defense victory following arbitration by employee involving retaliation and wage and hour claims.
Obtained dismissal on summary judgment of retaliation and harassment claims brought by two former employees of a hospital.
Won summary adjudication on individual’s claim for retaliation, discrimination and harassment, and victory at trial on individual’s wage and hour claims.
Secured a complete defense verdict in a case brought by a former employee who alleged that she was terminated because she complained about various safety issues. Arbitrator found no basis for the employee’s purported safety complaints and ruled that the termination was warranted based on performance issues.
Defended charter school in race discrimination case brought by a former employee. Plaintiff dismissed the case after her deposition was taken and the questioning established that she had no factual basis for her claims.
Represented clients in numerous administrative proceedings before state and federal agencies. Obtained case closure in all that we have handled to date.
Obtained preliminary injunction on behalf of company in action against former executive who allegedly misappropriate company assets.
Represented a company in securing an emergency TRO against a former employee who was harassing current employees at their job site.
Achieved complete victory on summary judgment on claims by former employees that their employer had breached fiduciary duties owed to them as shareholders.
