Krista Hernandez is a business litigator and counselor with experience representing companies in disputes in state and federal court, private arbitrations and before administrative agencies. Her practice includes representation of large corporations and small businesses in breach of contract, shareholder derivative and real property matters. She also represents health care clients, including medical groups, independent practice associations, and health care systems in a variety of matters including employment and reimbursement matters.
Ms. Hernandez has a specialty practice in environmental law, including litigation, defense of agency enforcement actions, regulatory compliance and counseling, and transactional matters with environmental issues. She has broad experience with contaminated properties, including both civil and administrative procedures, including toxic tort and cost recovery litigation, and appeals of actions taken by administrative agencies. Her experience crosses a wide variety of environmental media, including soil and groundwater contamination, air emissions, vapor intrusion, and solid and hazardous wastes. She has experience working with scientific experts in fate and transport, groundwater modeling, vadose zone modeling, remediation, toxicology, epidemiology and medical causation, and has a passion for developing strategies to more effectively communicate complex scientific concepts to factfinders.
Administrative matters have included representation of clients before the South Coast Air Quality Management District, Regional Water Quality Control Board and the Environmental Protection Agency, and counseling with regard to water quality permitting, compliance, and enforcement issues in California. Ms. Hernandez has also handled environmental aspects of complex real estate and corporate transactions, including review and analysis of environmental diligence materials and coordination of appropriate follow up inquiries, coordination of environmental review of properties by environmental consultants (Phase I and Phase II Environmental Site Assessments), and drafting and negotiating environmental contract provisions including allocation of environmental liabilities.
Ms. Hernandez is a member of the State Bar of California, the Bar of the Central and Eastern Districts of California, and the Los Angeles and Orange County Bar Associations. Ms. Hernandez is a member of the executive committee of the Environmental Law Section of the Los Angeles County Bar Association.
Ms. Hernandez is a graduate of Wellesley College, graduating cum laude with a Bachelor of Arts in sociology. She received her J.D. with honors from the University of Chicago.
Prior to joining Doll Amir & Eley LLP, Ms. Hernandez practiced law at the Los Angeles office of Gibson, Dunn & Crutcher LLP, where she was in the Litigation Department and a member of the Environmental Litigation and Mass Tort Practice Group.
